Please feel free to call us if you have any questions or comments. We always strive to find customer-oriented solutions. Of course, your rights will remain fully valid regardless of whether or not you give us a call. Online providers, in particular, are required by law to provide comprehensive information regarding any contract concluded with them and the applicable terms and conditions. We have compiled this information and our other shipping terms for you below.
1. Scope of application, governing law and definitions
1.1. All our business transactions and supplies are exclusively governed by the following Terms and Conditions, which apply to all contracts entered into with us based on the products offered in our online shop.
1.2. All legal transactions or other legal relationships with us are governed by the laws of the Republic of Austria, excluding the rules of private international law.
1.3. For contracts with consumers, this choice of law only applies insofar as the consumer is not deprived of the protection afforded to them by provisions that cannot be derogated from by agreement by virtue of the law of the country where the consumer has their habitual residence.
1.4. We ship to Austria and Germany.
1.5. We reserve the right to amend the Terms and Conditions due to legislative changes, supreme court rulings, technical innovations in the software used to run the online shop, or market conditions. Customers will be informed of any amendments to the Terms and Conditions through our website no later than one week before the amendments take effect.
2. Possibility to save and access the text of the contract
2.1. You can access these Terms and Conditions on our checkout page https://shop.viennasightseeing.at/ You can also print and save this document.
2.2. Additionally, you can archive your order details simply by printing the data summary given on the checkout page of the online shop using the print function of your browser or wait for the automatic order receipt confirmation, which we will send to you by e-mail after completion of your order to the e-mail address you have specified. This e-mail confirming the receipt of your order contains your order details as well as these Terms and Conditions, and can be easily printed and/or saved using your e-mail application.
2.3. Your order details will be stored by us but cannot be directly retrieved by you for reasons of security.
3. Contractual partner, language and conclusion of the contract
3.1. Your contractual partner is VIENNA SIGHTSEEING TOURS – Wiener Rundfahrten GmbH & Co. KG. For more information about our company, please see the legal notice.
3.2. Our contractual terms, all other information, customer service, data information and complaints handling are offered in German and English.
3.3. Once you have selected the desired product, you can add it to your shopping cart, without any obligation to purchase, by clicking the “Book” button. You can view the contents of your cart at any time, without any obligation to purchase, by clicking the “Book” button. You can remove products from your cart at any time by clicking the red X. If you want to purchase the products in your cart, click the “Complete Purchase” button on the checkout page, where you can provide your personal details and specify the shipping and payment method and where you can review the information you have provided one last time. You can cancel the order process at any time by closing your browser.
By checking “I have read and accept the terms and conditions” on the checkout page before placing your order, you declare that you accept and agree to be bound by these Terms and Conditions.
By clicking the “Complete Purchase” button, you place a legally binding order for the products in your shopping cart. The receipt of your order will be confirmed immediately after it was placed. This is merely an acknowledgment of receipt of your online order but not an order confirmation.
4. Prices
4.1. Prices for orders in our online shop are as stated therein at the time of placing the order. The prices shown are final prices, which means they include value added tax at the applicable statutory rate.
5. Payment
5.1. We generally accept payment by credit card (VISA, Mastercard) for your purchases. Whenever an order is placed, we reserve the right not to offer certain methods of payment and refer to other payment methods accepted by us.
5.2. If you pay by credit card, your credit card account will be debited after your order has been completed. If the order is cancelled, the purchase price will be refunded to your credit card.
6. Your statutory right of withdrawal and/or your right of withdrawal as a consumer
6.1. Below, you will find the legally prescribed information for you as a consumer regarding the requirements and consequences of your right of withdrawal.
6.2. You do not have a statutory right of withdrawal as a consumer because we provide services in connection with your recreational activities, i.e. city tours and trips, which you, as a consumer, have booked for a specific time or period and which we provide at the time or period chosen by you (section 18 (1) item 10 of the Austrian Distance and Off-Premises Contracts Act [FAGG, Fern- und Auswärtsgeschäfte-Gesetz]).
6.3. Any TOUR booked on www.viennasightseeing.at can be cancelled free of charge up to 24 hours before the tour starts (exception: Bratislava -> 72 hours). After that time, we reserve the right to charge a 100% cancellation fee.
6.4. Any HOP ON HOP OFF tour booked on www.viennasightseeing.at can be cancelled free of charge up to 24 hours before the tour starts. After that time, we reserve the right to charge a cancellation fee as follows:
- Up to 12 hours before tour departure: 25% cancellation fee
- Up to 2 hours before tour departure: 50% cancellation fee
- Tour already started: 100% cancellation fee
6.5. Flexi PASSES purchased through the online shop of viennasightseeing.at can be fully refunded up to 7 days from the purchase date provided that the web vouchers have not yet been redeemed.
7. Limitations of liability
7.1. We are only liable for any loss or damage incurred by the customer in the context of a business transaction in the case of wilful intent or gross negligence or in the case of wilful intent or gross negligence by the vicarious agents working for us. Any liability for slight negligence is excluded, except in the case of personal injury. This exclusion of liability also applies to consequential damage caused by defects.
7.2. As the operator of the online shop indicated in the legal notice, our company provides its services with the utmost care but is not liable for any services made available or rendered by third parties.
7.3. Any use of the Vienna Ring Tram is subject to the Conditions of Carriage and the limitations of liability of Wiener Linien.
7.4. Any use of the Flexi PASS is subject to the terms and conditions and the limitations of liability of VPG Vienna Pass GmbH. VPG Vienna Pass GmbH is not liable for any deficiencies, damage, losses or non-provision of services by individual contractual partners (“sights” or “attractions”) in connection with the use of Flexi PASSES. Any complaints and claims the pass holder may have regarding the use of the services of a contractual partner can therefore only be raised against the relevant contractual partner of VPG Vienna Pass GmbH. In such a case, the terms and conditions of the relevant contractual partner of VPG Vienna Pass GmbH thus apply. Where claims cannot be derogated from by agreement and/or there is a liability of VPG Vienna Pass GmbH towards the pass holder, the liability of VPG Vienna Pass GmbH is limited to a maximum of 50% of the actual price paid for the Flexi PASS.
7.5 Check the current entry requirements of the respective destination country as well as the current entry requirements for Austria in connection with your return journey, both when making your bookin and immediately before you start the booked day trip. You are responsible for compliance with these provisions. We are not responsible for the fact that the authorities may allow you to enter the country. Complaints in this regard are not accepted by us and do not entitle to reimbursement of the purchase price.
